“Finance Buddy” app privacy policy

This is the Privacy Policy (“Policy”) of Cognitree Technologies Pvt. Ltd., a company incorporated under the laws of India (“Company”) that owns the FinanceBuddy App. When we say “Finance Buddy,” “our,” “we” or “us,” we’re talking about the “Company”.

Our Privacy Policy helps explain our information practices. FinanceBuddy receives or collects information when we operate and provide our Services, including when you install, access, or use our Services. We talk about what information we collect and how this affects you. We also explain the steps we take to protect your privacy.

  1. The App and Clients

    Company has developed and solely owns a mobile personal finance software application called “FinanceBuddy” (“App”which expression shall include future releases of the App). Company makes the App available for download and use on mobile phones to clients (“Clients”).

    Downloading and installing the App shall be deemed to constitute sufficient proof that Clients have read, understood and accepted this Policy.

    By using or accessing the App in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy.

  2. Personal Information

    We commit to respecting your online privacy data. We further recognize your need for appropriate protection and management of any personally identifiable information (“Personal Information”) you share with us.

    “Personal Information” for the purposes of this Policy means information that is contained in text messages (SMS) sent by providers of services and/or products (including but not limited to retail outlets, financial institutions, mobile carriers and utility companies) to the mobile telephone numbers of Clients in connection with one or more transactions (including availing of services or products, order confirmation, billing information and renewal notifications related thereto)

    1. Mobile phone numbers of Clients
    2. Email addresses of Clients
    3. Partial payment card data only to the extent such card data is disclosed in the said messages.
    4. Information related to the transaction in question including identity of the service or product and the price or fee paid or payable in respect thereof.

    In case you participate in any other schemes, facilities, services provided by the App, you may be required to provide additional information. Such information will also remain in the Company’s database and will be considered as your Personal Information and will be treated as confidential.

    You may provide us with information related to your use of our Services, and how to contact you so we can provide you customer support. For example, you may send us an email with information relating to our app performance or other issues.

  3. Non-Personal Information

    We collect service-related, diagnostic, and performance information. This includes information about your activity (such as how you use our Services, how you interact with others using our Services, and the like), log files, and diagnostic, crash, website, and performance logs and reports.

    If you pay for our Services, we may receive information and confirmations, such as payment receipts, including from app stores or other third parties processing your payment.

    We collect device-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, browser information, IP address, mobile network information and device identifiers.

  4. Purpose of Collection and Use of Personal and Non-personal Information

    Company may collect, store, access and use Personal Information solely to the extent required for Company to enable Clients to utilize the features of the App and to provide better user experience to Clients and for assessing credibility of customers.

    The transactional SMS data hence is collected and stored on the user device.

  5. Sharing of Personal Information with Third Parties

    Company shall not publish, sell, give on rent, trade or otherwise transfer Personal Information to third parties, except as may be required by law, or pursuant to the order of a court or regulatory authority, or in order for Company to enforce its rights. In the event Company needs to share Personal Information with third parties, Company shall enter into non-disclosure agreements that are, at the least, as protective as the provisions of this Policy.

  6. Choice

    Company reasonably presumes that Clients who transmit Personal Information to Company are doing so out of their own volition. Company does not compel Clients to disclose Personal Information. At any time, Clients may opt not to provide Personal Information by uninstalling the App.

  7. Communications

    We will send registered users communications related to the servicing of your account when necessary to do so.

    We will send registered users service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email.

    You may not opt-out of account servicing communications or service-related announcements, which are not promotional in nature.

    We will send registered users occasional emails updating you about new products, special offers, or other information which we think you may find interesting. You may unsubscribe from these at any time. If you haven’t provided us with your email address, you will not receive these communications.

  8. Correctness and Integrity of Personal Information

    Company accesses Personal Information as aforesaid from SMS messages on an ‘as is’ basis. Therefore, Company shall not be responsible in any way for the correctness, completeness and integrity of any Personal Information collected hereunder.

  9. Security

    Company shall take all reasonable precautions by way of using current industry standard encryption technologies to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction.

  10. Limit of Liability

    Notwithstanding anything to the contrary in this Policy or any other terms of service or use applicable as between Company and Clients, Company’s aggregate liability hereunder shall be limited to Rs.1000 (Rupees One Thousand Only) only and shall not extend to any indirect or remote damages whatsoever, including but not limited to special, incidental, consequential, or punitive damages or loss of profits.

  11. Enforcement

    For any inquiries and complaints, the following email address may be used: financebuddy@cognitree.com. All inquiries and complaints shall be looked into promptly and without charging any fee to the inquirer / complainant.

  12. Compliance

    Company shall always cooperate with regulatory authorities and investigating agencies in India in the matter of treatment of Personal Information.

  13. Amendments

    Company may modify this Policy in its sole discretion at any time. While Company shall make best efforts to notify Clients of any such modification, it shall be Clients’ responsibility to read and understand the Policy as prevalent from time to time. Installation of the App shall be deemed to constitute acceptance of the Policy as amended.

  14. Governing Law and Dispute Resolution

    This Policy shall be governed by and construed in accordance with the laws of India. The courts at New Delhi, India shall have exclusive jurisdiction in relation to any disputes arising out of or in connection with this Policy.
